AB 992 - Amended

AB 992 was amended by the author on 4-22 and re-introduced to the Health Committee on 4-23. A couple of things stick out as I read it:

CHAPTER 2.8. FIREARMS-RELATED EMERGENCY SERVICES REIMBURSEMENT 12330. (a) (1) There shall be imposed a fee upon all munitions sold at retail at the rate of 10 cents ($0.10) for each munition sold at retail in this state on or after January 1, 2004. (2) Except as provided in paragraph (1), the fee shall also be imposed upon and paid by the purchaser of munitions for munitions purchased outside of the state and that are intended to be stored or used in the state.

and

( j), the fee imposed pursuant to subdivision (a) shall be increased by one cent every two years, commencing January 1, 2006, provided however, that fee imposed pursuant to this section shall not exceed the costs authorized for expenditure pursuant to subdivisions (f) and (g).



so, it appears they are trying to close the possibility that we will purchase our ammunition outside thew state...and they want to be able to raise the 'fee' as they see fit on a yearly basis.


I suggest everyone read the amended bill and stay tuned for more updates to it as it progresses each step along the way.

This stuff drives me crazy. I need to write some more letters. Where&#39;s my stamps!? Where do people come up with this stuff? And they call this an "Emergency Services Reimbursment"? Maybe they need to reimburse me for not getting my moneys worth from the taxes I pay.

I agree - this is all BS.....and my hope is that everyone that writes to the legislature will express their total disgust with a bill that will be absolutely un-enforceable and end up costing us more than it brings in.

The State&#39;s own BOE (Board of Equalization) says this about the bill:

"BOE estimates that the 10% fee would create a revenue of $72.8 million annually. BOE has also indicated that imposing varying fees on specific commodities will complicate tax administration, which could result in increase administrative costs to BOE. BOE also states that adding a fee on a specific commodity would require retailers to keep track of munition sales separately from other sales of tangible personal property; and since the fee is based on individual munition, rather than gross receipts, reporting errors are likely to occur. "

How can they enforce this??

I&#39;ve never been asked to show ID when buying ammo. Would this be something they have to start doing??

They will "tax" mailorder and internet orders when the address is CA. They will probably require any company selling ammo into CA to collect for and submit the money to CA&#39;s collection system. What this will do is cause mailorder and internet companies not to sell ammo to CA addresses. Pretty smart tactic for bunch of liberal Dumb-as-craps. Currently if you buy mail order and use the article in CA, you are supposed to pay the "use tax" which is basically equal to the sales tax. When we buy mail order we think we are saving on sales tax, we are really cheating the state of their "use tax" if we don&#39;t declare it. I would bet the ammo fee would work the same way, making us into instant lawbreakers.

The state has already figured out how to assess and collect tax on out of state purchases. When they jacked up the taxes on cigarettes, folks who ordered from out of state started getting tax notices from the state. I don&#39;t smoke, but I have seen several of these tax due bills. That leaves us with going and getting it in person and risking a smuggling rap - which I suspect would be spun as a gun-related crime, potentially affecting your ability to own firearms.

Think about the impact on a day of shooting - $10 tax on each round of sporting clays, a $2.50 tax on each round of trap or skeet, a $5.00 tax on each box of pistol ammo used up at the range. A $50 dollar tax for plinking a brick of .22s with the kids. This would really be the final nail in the coffin for the shooting sports for a lot of people - which is exactly what the authors intend.
