ODFW Seeks Public Comment on Proposal to Waive Fish Passage at a Pistol River Area Forest Operation

South Coast Lumber proposes mitigation at a Pistol River tributary near Deep Creek



GOLD BEACH — The Oregon Department of Fish and Wildlife (ODFW) seeks public comment on a proposed Fish Passage Waiver Agreement (Agreement) between the agency and South Coast Lumber to waive fish passage requirements at a proposed road crossing on South Coast Lumber road #38-13-18.0.

State law requires fish passage at artificial obstructions, but allows the Oregon Fish and Wildlife Commission to waive requirements if the alternatives proposed provide a net benefit to native migratory fish. A Memorandum of Understanding between the Oregon Department of Forestry and ODFW delegates the Fish and Wildlife Commission’s authority to ODFW field staff for certain activities related to the Oregon Forest Practices Act.

South Coast Lumber is seeking a waiver for upstream fish passage at the proposed road crossing because passage would provide little biological value to native fish. A series of cascades on the Pistol River tributary block steelhead, cutthroat trout, and Pacific lamprey passage approximately 50 feet upstream of the proposed road crossing.

Pistol River Fish Passage Waiver, continued

As mitigation for the proposed fish passage waiver, South Coast Lumber proposes to restore fish passage on an adjacent Pistol River tributary by removing a culvert on South Coast Lumber Road #38-14-13.6. The proposed culvert removal would provide steelhead, cutthroat trout, and Pacific lamprey access to an additional 200 feet of habitat.

If the Agreement is approved, South Coast Lumber would construct the crossing on road #38-13-18.0 and remove the culvert on road #38-14-13.6 between July 15, 2003 and September 30, 2003.
